Terms of Service
These Terms of Service govern access to and use of Just Risen LLC’s websites, forms, websites we build, the Growth Platform, communications tools, and related services. Browsing our website is subject to the terms that govern website use, but paid services are accepted only through a signed agreement or a checkout or order process that clearly presents these Terms and records your affirmative acceptance. Merely viewing a website or submitting an inquiry does not authorize charges or marketing.
In brief, paid services work as follows: the Growth Platform is $97 per month on a month-to-month basis or $970 per year on a 12-month annual term, plus a standard $497 setup fee, and subscriptions auto-renew until canceled. To cancel, email [email protected] at least 3 business days before the renewal date, by 11:59 p.m. Central Time; cancellation takes effect at the end of the current paid period. Monthly payments are not refunded when you cancel. Annual fees are refunded only for plans canceled within the first 90 days, and then only for unused full months on a pro-rata basis; after 90 days, annual fees are not refunded. Sections 6 and 7 state the complete billing and cancellation rules.
1. Agreement, eligibility, and authority
These Terms apply between Just Risen LLC and the person or business ordering its services. If acting for a business, you represent that you are authorized to bind it. Business services and the Just Risen SMS program are intended for adults at least 18 years old.
Service terms are accepted through a signed agreement or a checkout or order process that clearly presents these Terms and records affirmative acceptance. Merely viewing a website or submitting an inquiry does not authorize charges or marketing. Privacy disclosures describe data handling; they are not a substitute for any legally required consent.
A mutually accepted proposal or order may add service-specific terms and controls a conflict for that service. An invoice alone does not authorize new terms or charges that were not agreed. The accepted order confirms the package, price, deliverables, and any service-specific terms for that client.
2. Services and third-party platforms
Just Risen provides business growth services that may include website design and setup, hosting configuration, customer relationship management, lead capture, missed-call text-back, appointment tools, automated follow-up, review requests, email and SMS tools, social or advertising integrations, reporting, training, and support.
The Growth Platform is powered in material part by GoHighLevel/LeadConnector and may rely on other third-party services for domains, email, telephony, text delivery, payments, calendars, analytics, social media, maps, artificial intelligence, and integrations. Third-party services are governed by their own terms and privacy policies.
We may update, replace, or improve features as technology and business needs change. We do not guarantee that every third-party feature will remain available, unchanged, or compatible with every account or integration.
3. Free starter website offer
If offered, “free starter website” means only the initial build labor specifically included in the accepted written offer is charged at $0. It does not imply free hosting or domain services beyond an active subscription, unlimited revisions, ongoing maintenance, a portable code export, or perpetual platform access. Any required paid subscription or other cost must be disclosed before the client accepts the offer.
- Included build: A single-page, template-based website with up to five sections — Home, Services, About, Reviews, and Contact — branded to the business, with a contact or quote form, click-to-call, mobile-friendly layout, and basic on-page SEO.
- Content and revisions: Just Risen drafts page copy from the client's intake answers. The client supplies the logo, photos, and business information. Two revision rounds are included; a round means one consolidated list of changes, and approval is confirmed by email sign-off.
- Timing and eligibility: The offer requires an active Growth Platform subscription and complete content and account access. The delivery target is 14 business days after we have complete content and access; required approvals and third-party dependencies may extend that target.
- Required costs and duration: Growth Platform is $97 per month or $970 per year. The standard setup fee is $497. We may offer a discounted setup price during a live demo. Any such price applies only when we explicitly offer it, you accept it within the stated offer period, and the price is recorded in your accepted order. No promotional discount is guaranteed. Hosting is included while the subscription is active. Standard domain registrations are included in your subscription: Just Risen purchases your domain and maintains it in one place for you while your subscription is active — no separate bill for a standard domain. Premium or aftermarket domains (where the registry or a prior owner charges above the standard registration price) are billed at cost, with no markup (see sections 6 and 8). You own the domain; if you cancel, you can transfer it to your own registrar at no transfer fee (see section 8). Monthly billing has no minimum term; annual billing is a 12-month term.
- Excluded work: Ecommerce, custom development, additional pages, premium assets, complex integrations, and work outside the completed scope require a separately accepted quote unless expressly included.
- Exit terms: If the subscription ends, the client may request an export of its text and images during the 30-day export window in section 7. The export does not include a portable, functioning website or source code. Migration or rebuild help is quoted separately. Section 8 explains why a hosted site is not necessarily a portable website.
The accepted order must match this scope. Additional pages, custom website work, ecommerce, or migration work requires a separate quote before the work begins.
4. Client responsibilities
To receive the services, you agree to:
- Provide accurate, complete information and update it when it changes.
- Supply logos, photos, text, credentials, domain access, and approvals when requested.
- Confirm that you own or have permission to use all content, trademarks, images, reviews, testimonials, and data you provide.
- Review websites, campaigns, automations, and public-facing content before launch and notify us promptly of errors.
- Keep account credentials secure and remain responsible for activity under your accounts.
- Maintain any required business licenses, insurance, registrations, and legal compliance for your business.
- Respond to leads and customers generated through the system; Just Risen provides tools and setup but does not become your sales, dispatch, legal, accounting, or customer-service department unless expressly agreed in writing.
Delays caused by missing information, inaccessible accounts, third-party verification, or late approvals may extend delivery dates and may require rescheduling.
5. Email, SMS, and marketing compliance
Just Risen LLC SMS program: Adults who affirmatively opt in may receive appointment, project, account, or support texts; promotional offers are sent only with separate marketing consent. Frequency varies; message and data rates may apply. Consent is not a condition of purchase. Reply STOP to unsubscribe and receive an opt-out confirmation; reply HELP for assistance or contact . Carriers are not liable for delayed or undelivered messages. See our Privacy Policy messaging section for data handling and consent choices.
You are responsible for the lawfulness of your marketing lists, messages, offers, and customer communications. Before Just Risen sends or helps configure email, SMS, or automated outreach for your business, you must have the consent and legal basis required by applicable law and carrier rules.
- Do not use purchased, rented, scraped, or borrowed lists for SMS campaigns. Consent must be documented for the actual sender and intended messages and must comply with carrier and platform rules; a list purchase does not establish consent.
- Honor opt-out, unsubscribe, revocation, quiet-hour, and suppression requests promptly.
- Identify your business clearly and include required contact and opt-out information in marketing messages.
- Do not send deceptive, unlawful, harassing, or prohibited content, or content that violates carrier, platform, or industry rules.
- You are responsible for A2P registration information, campaign descriptions, business identity details, and maintaining the accuracy of those records when they concern your business.
We may pause or refuse messaging that appears unlawful, lacks adequate consent, creates carrier or platform risk, or violates these Terms. Carrier filtering, delivery delays, and third-party blocking are outside our sole control, and message delivery is never guaranteed.
6. Subscriptions, taxes, variable charges, and payment
Growth Platform pricing is $97 per month on a month-to-month basis with no minimum term, or $970 per year on a 12-month annual term. The standard setup fee is $497. We may offer a discounted setup price during a live demo. It applies only if we explicitly offer it, you accept it within the stated offer period, and the discounted amount is recorded in your accepted order (see section 3). Subscriptions auto-renew until canceled; the renewal date is the same calendar day as the start date for the selected monthly or annual cycle unless the accepted order states another date. Automatic renewal and recurring charges apply only when clearly disclosed and affirmatively authorized through the order process. Providing a payment method alone does not authorize unspecified fees.
Pass-through and usage costs may include A2P registration and recurring campaign and carrier fees, telephone numbers, call minutes, SMS/MMS segments and carrier fees, email volume, AI usage, premium or aftermarket domains, and premium integrations. All pass-through costs — including A2P registration/carrier fees, phone numbers, messages, AI usage, and premium domains — are billed at the actual platform or carrier cost with no markup by Just Risen. Usage is billed monthly in arrears at those cost rates as stated in the accepted order or approved rate schedule (a premium or aftermarket domain is billed at cost when purchased or renewed). The client may request a written spending cap for usage charges. If a wallet or automatic top-up is used, the trigger and amount must be disclosed and authorized before it is enabled. SMS carrier charges incurred by a recipient are separate from client platform billing.
Applicable taxes, setup charges, approved add-ons, and third-party charges must be disclosed as included or separate. We charge only amounts authorized in the accepted order or subsequent approved changes. If a payment fails, we will send email notice and give the client 7 days to cure before services may pause. We will give at least 30 days' notice of a price change; the client may cancel before the change takes effect instead of accepting it. Monthly plans are not refunded when canceled; service continues through the end of the paid period. For annual plans canceled within the first 90 days, Just Risen will refund unused full months on a pro-rata basis; after 90 days, annual fees are not refunded. Mandatory legal billing and refund rights apply.
7. Cancellation, suspension, termination, and client data
To cancel recurring services, email a written request identifying the business, account, and services to at least 3 business days before the renewal date, by 11:59 p.m. Central Time. Cancellation takes effect at the end of the current paid period, and access continues through that date. Just Risen will send written confirmation within 2 business days identifying the effective date and any authorized final charges. Refunds and proration follow section 6. An acknowledgment delay does not invalidate a timely request. Texting STOP ends SMS consent; it does not cancel a subscription.
Any final charge is limited to amounts authorized by the accepted agreement, such as usage already incurred or an expressly agreed remaining commitment. No separate cancellation penalty applies unless it was expressly agreed in the accepted order. Applicable statutory cancellation rights take precedence.
We may suspend affected services when reasonably necessary to address unlawful use, security threats, carrier requirements, or a material breach. Where feasible, we will explain the reason and provide the agreed notice and opportunity to cure; urgent legal or security situations may require immediate action. For nonpayment, services may pause after the 7-day cure period in section 6 if payment is not received. Suspending a service does not waive our obligations under law or the agreement.
Termination may stop hosting, forms, booking, automations, and communications. Before service ends, the parties should identify domain and phone-number control, disable campaigns and billing renewals as appropriate, revoke access, and arrange permitted data return. Phone-number porting and account transfer depend on provider rules and verified authority and are not guaranteed by these Terms.
During the 30 days after termination, the client may request an export of eligible records, which may include contacts, form submissions, page text, and media in standard available formats, consistently with Privacy Policy section 8. Transfer assistance, migration, or rebuild help is quoted separately unless expressly included in the accepted order. We delete eligible client data from active systems within 30 days after the export window closes, using the deletion tools and account controls made available by our platform providers; backups expire on the provider's normal rotation cycle. Export requests must be authenticated and protect third-party rights. Following the return/deletion process, access ends and data may no longer be recoverable. Legally retained or backup records remain restricted to the stated purposes; indefinite retention or recovery is not promised.
8. Website ownership, exports, confidentiality, and portfolio use
Client materials and records: You retain your rights in materials you supply, including your name, logos, photos, text, and business records, subject to third-party rights and individuals' privacy rights. You grant us a limited license to process, copy, format, and display these materials only as needed to provide the agreed services. This license does not authorize public promotion or use of customer data for our marketing.
Website build: The client owns its content and the custom copy and design created specifically for the client once the related amounts are paid in full. Just Risen retains rights in pre-existing templates, reusable workflows, automations, know-how, and software configurations it owns or licenses. While the subscription is active, the client has a license to use the hosted site design and retained platform components as part of the services. Third-party platform software and licensed assets remain subject to their owners' terms.
What ownership does not include: Ownership of custom creative elements — page copy, branding choices, or design elements created specifically for you — does not transfer ownership of the underlying template, the hosted implementation, the platform software, workflows, or automations used to build or run the site. It also does not, by itself, entitle you to take the functioning hosted website to another host or platform. On cancellation you receive the export described in section 7 (your text, images, and records); the live site, its code, and its integrations stay with the platform unless a transfer or rebuild is separately agreed and priced.
Hosted access versus portable export: Access to a HighLevel-hosted site is use of a hosted service. A content export means copies of the agreed client text, images, or records in the specified available format; it does not necessarily include a functioning independent site, source code, hosting account, automations, integrations, or platform licenses. A same-platform transfer is a different process from migration to another host. Any available transfer, code export, or rebuild must be expressly scoped and priced before it is ordered.
Domains and accounts: Unless expressly agreed otherwise, Just Risen purchases your domain and maintains it in one place for you while your subscription is active, including registration, renewal, and DNS configuration. Standard domain registrations and renewals are included in your subscription. Premium or aftermarket domains — where the registry or a prior owner charges above the standard registration price — are not included and are billed at cost, with no markup. You are listed as the domain’s registrant even while Just Risen manages billing and DNS on your behalf, and you own the domain. If you cancel or transfer service, you may transfer the domain to your own registrar account; after transfer, you are responsible for renewal and management. There is no fee for a standard domain transfer — that is, unlocking the domain and providing the transfer authorization (auth/EPP) code and the information your new registrar needs to complete the transfer. Your receiving registrar may impose its own charges, and registrar transfer restrictions, waiting periods, or eligibility requirements outside Just Risen’s control may apply. We will initiate a standard transfer within 5 business days after a verified request from an authorized account contact; that commitment covers the transfer actions within Just Risen’s control. Help beyond the transfer itself — such as migrating your website, reconfiguring DNS at the new host, or rebuilding the site elsewhere — is quoted separately. The accepted order should identify admin access for connected accounts and numbers. Hosting access does not establish domain ownership. Transfers require verified authority and compliance with provider requirements.
Confidential information: Each party will protect the other's nonpublic business information using reasonable care, use it only for the agreed services, and limit disclosure to authorized people and providers who need it and are bound by appropriate confidentiality duties. Exceptions include information lawfully public, independently developed, or lawfully received without restriction. Legally compelled disclosure is limited to what is required, with notice where permitted. Client credentials, private records, and customer information are not portfolio materials. Confidentiality continues while the information remains confidential; personal data follows the retention and deletion provisions.
Portfolio permission: We require your prior written permission before naming you as a client, displaying your logo or project, or publishing a testimonial or case study. Permission must identify the approved material and channels. Silence or use of our services is not permission. Customer information and confidential details require separate lawful authority and must not be exposed by screenshots or demonstrations.
Report suspected infringement through the contact channel with details identifying the material and your rights. We may restrict access while reviewing a claim.
9. Acceptable use
You agree not to use Just Risen services to:
- Violate a law, regulation, court order, carrier rule, or platform policy.
- Send spam or unlawful telemarketing, or misrepresent the sender, offer, price, or business identity.
- Infringe intellectual-property, privacy, publicity, or other rights.
- Upload malware, attempt unauthorized access, interfere with a network, or probe security controls.
- Collect or use another person’s information without authority.
- Post or transmit fraudulent, deceptive, defamatory, harassing, or otherwise unlawful content.
- Use the services for a business or activity that Just Risen reasonably determines creates unacceptable legal, financial, security, or reputational risk.
10. No guaranteed business results
Just Risen provides tools, implementation, automation, and support. We do not guarantee a specific number of leads, calls, appointments, reviews, rankings, sales, revenue, search-engine placement, advertising performance, message-delivery rate, or business outcome.
Results depend on factors outside our control, including your market, pricing, reputation, responsiveness, advertising budget, competition, customer demand, third-party algorithms, and the accuracy of the information you provide. Any examples, demonstrations, testimonials, or projections are illustrative and are not promises of future performance.
11. Warranties, limitation of liability, and indemnity
Except for express obligations in an accepted service agreement and rights that law does not permit us to exclude, services are provided “as is” and “as available.” To the extent permitted by law, implied warranties of merchantability, fitness for a particular purpose, and non-infringement are disclaimed. We do not promise uninterrupted or completely secure operation. These statements do not erase agreed deliverables or mandatory duties.
To the extent permitted by law, neither party is liable for indirect, incidental, special, consequential, or punitive damages, including lost profits or lost revenue. Just Risen's aggregate liability arising out of or relating to the services is capped at the fees paid to Just Risen for the services in the 12 months before the event giving rise to the claim. This cap does not apply to fraud, willful misconduct, or gross negligence, or to liabilities that applicable law prohibits limiting. Unless expressly agreed otherwise in writing, confidentiality, data-protection, and indemnity obligations are subject to this same cap to the extent permitted by law. Labels such as “lost data” do not automatically exclude all direct losses.
To the extent permitted by law, a business client will indemnify Just Risen against third-party claims and reasonable resulting costs only to the extent caused by the client's unlawful content or instructions, infringement by materials the client supplied without required rights, or material breach of its agreed messaging-consent obligations. This does not cover losses caused by Just Risen's own breach, negligence, unlawful conduct, or unauthorized changes. It does not create reimbursement for every first-party dispute.
Just Risen must promptly notify the client of a covered claim; delayed notice reduces the obligation only to the extent it materially prejudices the defense. The client may control the defense with competent counsel reasonably acceptable to Just Risen, with reasonable cooperation. No settlement may admit fault by, impose nonmonetary obligations on, or leave unreleased claims against Just Risen without its written consent. Any separate duty to advance defense costs or broader indemnity must be expressly agreed. These provisions remain subject to applicable law.
12. General terms, changes, governing law, and contact
Changes: We may update these Terms from time to time. The updated version will be posted on this page with a new effective or last-updated date. Material changes to an existing service agreement require the notice and acceptance process specified in that agreement and applicable law. Posting an update alone does not authorize new charges, change an accepted project scope, or obtain marketing consent.
Governing law: These Terms are governed by the laws of the State of Alabama, without regard to conflict-of-law principles. A dispute that cannot be resolved informally must be brought in a state or federal court with jurisdiction over Crossville, Alabama, unless applicable law requires another forum.
Assignment: You may not assign your account or obligations without our written consent. Just Risen may assign these Terms in connection with a business sale, merger, restructuring, or transfer.
Severability and waiver: If a provision is unenforceable, the remaining provisions stay in effect. A failure to enforce a provision is not a waiver of that provision or any later breach.
Entire agreement: These Terms, the Privacy Policy, and any signed proposal, order form, or service-specific terms form the entire agreement for the services and replace prior discussions about the same subject.
For questions about these Terms, contact Just Risen LLC, Crossville, Alabama through the contact or intake options on our website.
